General conditions of sale for purchases on NuiNui
NuiNui is produced by Snake SA - NUINUI, Via Agordat 29P, 13100 Vercelli, to be considered the sole owner of the site http://www.nuinui.it.
By using the services available on www.nuinui.it you accept the General Terms and Conditions of Contract described in full and without reservation. These Conditions apply to all orders placed, by any means provided below, for all items and services offered on the website www.nuinui.it.
NuiNui reserves the right to modify these conditions at any time, however intending the contract conditions accepted by the customer (hereinafter the "Customer") at the time of the order to be applicable to sales orders placed on the website www.nuinui.it .
The offer and sale on the NuiNui website integrate a distance contract governed by articles. 50 ff. of Legislative Decree 6 September 2005, n. 206 (Consumer Code), as well as by Legislative Decree 9 April 2003 n. 70 (so-called Electronic Commerce Law). The purchase of the products is intended for consumers.
These Conditions of Sale govern the relationship between the Customer and NuiNui for the purchase of the Products on the Site.
The Customer is required to carefully read the Conditions of Sale that NuiNui makes available to him also in order to allow him to reproduce and memorize the remembered Conditions in compliance with the provisions of the art. 12, co. 3rd of Legislative Decree no. 70/2003.
To purchase the Products, the Customer must enter their personal details, and must complete and send to NuiNui the purchase order form in electronic format available on the site, following the instructions contained on the Site. Purchase orders they must be filled out exactly in their entirety.
The Customer must insert the selected Product(s) into the appropriate "Cart" and, after having viewed and accepted the contribution for delivery costs, can proceed with the purchase.
If the Customer needs to modify the purchase order, or to modify some data contained therein, he must follow the specific modification procedure contained on the site. In particular, the Customer will have the right to change the quantity of the Products he intends to purchase, adding or eliminating one or more Products from the Cart.
Once this operation is completed, the Customer will see a screen containing the summary of the purchase order, including delivery costs, with a request for further confirmation of the purchase procedure.
After viewing the summary, the Customer must select the desired type of payment and confirm the purchase procedure.
Conclusion of the contract
With confirmation of the purchase order by the Customer, the conditions of sale and further information contained on the site will be considered fully known and accepted by the Customer.
The Order Confirmation by NuiNui sent to the Customer at the email address indicated will constitute acceptance of the contractual proposal.
The contract will be considered concluded, and will be binding for both parties, when the Order Confirmation is sent to the Customer.
After payment you will receive an email notifying you of receipt of payment and from that moment the timescales for preparing and shipping your order will follow.
If our staff finds errors in your order or deems your order not to be processed within the required time and manner, you will be notified promptly.
Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damage to people and/or things, caused by non-acceptance, even partial, of an order or by cancellation due to non-payment. within the established deadline.
In the product catalog published on the NuiNui website, the availability of the products, even being constantly updated, may undergo variations not in real time and without notice.
You are purchasing products that can be viewed and described on our site and you accept that the images of the products may not be perfectly representative of their characteristics but may differ in color and shades, dimensions or accessory products present in the picture.
The prices of the Products are expressed in Euros and include all applicable taxes and/or duties;
The prices of the Products do not include delivery costs, the amount of which will in any case be indicated to the Customer in the summary of the purchase order;
The price of the Product will be that indicated on the site at the time of the order. They will therefore not be able to detect any increases or decreases in the price, even in relation to promotional sales before or after the purchase order;
The Customer can choose between two payment methods: via PayPal™ account and/or credit card.
In case of purchase through the PayPal payment method, at the end of the order the Customer is directed to the PayPal login page. The amount relating to the order is debited from the PayPal account at the time the order is acquired. In the event of cancellation of the order, either by the Customer or in the case of non-acceptance by NuiNui, the amount will be refunded to the Customer's PayPal account. Cancellation of the order is possible until the moment in which it is not yet being processed. Once the cancellation of the transaction is requested, under no circumstances can NuiNui be held responsible for any damages, direct or indirect, caused by delay in the failure to release the committed amount by PayPal. At no time during the purchase process is NuiNui able to know the Customer's financial information. For each transaction carried out with the PayPal account the Customer will receive a confirmation email from PayPal.
Sales of products carried out via the internet are similar to mail order sales and, therefore, the provision contained in the art. 2, letter oo, of Presidential Decree 12.21.1996, n. 696, which provides for exemption from the obligation to issue a receipt or tax receipt. If you wish to request an invoice, you can contact NuiNui at ordini[at]nuinui.it with the necessary data (VAT number or tax code, complete personal details) before placing the order.
The delivery of the products will be carried out by courier and the times will vary depending on the destination, the moment in which the order is acquired and the availability of the Product itself.
For available goods NuiNui will deliver to the courier within 5 working days following receipt of the purchase order.
Barring unforeseen circumstances, delivery times on national territory will be 3 working days from delivery to the courier. For difficult to reach locations such as mountain resorts, smaller islands, extreme suburbs, delivery times will be 6 working days.
Our system will calculate your shipping costs based on the geographical origin of the Customer. Please carefully check the order summary and costs listed to avoid running into problems of various kinds before sending your order and above all BEFORE PAYMENT.
We draw Customers' attention to the days in which the courier, according to its terms of service, does not make deliveries:
- on Saturdays and Sundays;
- on public holidays during the week;
- during the holiday closure period established by the category of hauliers;
- on the days and times in which circulation on urban and/or extra-urban roads is prohibited by administrative provision;
- on days in which, by local custom or by order of the Public Administration, warehouses and/or offices, shops and companies remain closed;
- due to force majeure or fortuitous events.
Below are the price ranges for shipping:
- Italy: €4 for orders under €15, free shipping for orders of €15 or more;
- France, Germany, Austria, Spain, Belgium, Luxembourg, Holland, Denmark: 13 euros;
- Czech Republic, Slovakia, Spain, Balearic Islands, England, Sweden, Romania: 18 euros;
- Estonia, Latvia, Lithuania, Poland, Hungary, Slovenia, Bulgaria, Portugal, Ireland, Finland: 21 euros;
- Croatia, Greece: 24 euros;
Extra EU area: variable based on destination.
Guarantee for defective goods
If you find damaged goods inside your package, we invite you to send an email to our address ordini[at]nuinui.it within 24 hours of receiving the package, with attached photographic documentation relating to the damaged goods. The email must also contain the order and shipping number reference.
Once the case is opened, we will refund the cost of the goods or, if you prefer, replace them. The replacement of the goods will be carried out at our expense according to the warehouse availability of the item to be replaced.
In the event that one or more of the items purchased are not available in our warehouses in a short time, the Customer can inform us of another item of equal value that is available in our warehouses to his liking.
Right of withdrawal
1-Pursuant to and for the purposes of the articles. 64 et seq. Legislative Decree no. 206/05 the Customer may exercise the right of withdrawal, without any penalty and without specifying the reason.
The Customer must follow this simple procedure:
A) Send to NuiNui within 14 days of receiving the Product, via registered letter with acknowledgment of receipt, your wish to withdraw from the contract.
B) Arrange, using a courier of your choice, to ship the product to Snake SA - NUINUI, Via Agordat 29P, 13100 Vercelli, carefully packaged in the original packaging, inserting a copy of the registered letter sent inside.
B1) The communication may also be sent, within the same deadline, by telegram, e-mail and fax, provided that it is confirmed by registered letter with acknowledgment of receipt within the following 48 hours.
B2) NuiNui will refund the cost indicated in the purchase order and the first shipping costs, or that relating to the Products for which the right of withdrawal has been exercised, within 30 working days following receipt of the Products.
B3) The exercise of the right of withdrawal will be ineffective if the returned product is not intact, or the original packaging is missing, or if integral elements of the product are missing, or if the product is damaged for reasons other than transport.
The Customer will lose the Right of Withdrawal for lack of the essential condition of integrity of the Products (packaging and/or its contents), in cases where NuiNui ascertains:
- the lack or damage of the external packaging;
- the lack of the original internal packaging;
- the absence of integral elements of the Product (accessories, parts);
- damage to the Product for reasons other than its transport.
In the event of forfeiture of the Right of Withdrawal, NuiNui will return the purchased goods to the Customer, charging the shipping costs and will not refund the price paid.
The customer accepts that in case of disputes the competent court will be that of Vercelli.
Request to replace an item
The replacement procedure for a Product or one of its components may be activated as a result of the occurrence of one of the following hypotheses:
a Product different from the one the customer ordered and, therefore, not present in his order was mistakenly shipped by NuiNui. Should this occur, the Customer must refrain from opening the package and immediately report the error to NuiNui by email in order to allow appropriate checks to be carried out;
the purchased Product does not appear to be working from the first use;
the Product is incomplete in some components listed on the site.
In each of the cases listed above, the shipping costs will be borne by NuiNui and the return shipment will be carried out via courier. The Customer who decides to request the replacement of a Product should, before organizing the return shipment, contact NuiNui at the email ordini[at]nuinui.it, including the order number.
NuiNui reserves the right to inspect the Product before accepting or rejecting the return. If all the required conditions are respected, the Customer will be replaced with the Product in compliance with the order placed at the time. In the event that NuiNui does not have the Product to be replaced available, it will refund the price of the Product within 30 days of receiving the Product by bank transfer, upon communication of the bank details by the Customer. If the return conditions as set out in this article are not respected, the returned Product will not be accepted and the Customer may choose to have the purchased Product returned, bearing the redelivery costs. In case of refusal of the shipment NuiNui reserves the right to withhold the Product and the corresponding amount.
